These Terms should be read together with our Shipping Policy, Refund Policy and Privacy Policy. If you are acting as a consumer, nothing in these Terms limits or excludes rights that cannot lawfully be limited or excluded under applicable consumer law.
1. Using Our Website
You may use our website only for lawful purposes and in accordance with these Terms. You must have the legal capacity required under applicable law to enter into any purchase you make through the website.
You must not use the website to commit or facilitate unlawful, fraudulent or abusive activity; interfere with the security or operation of the website; introduce malicious code; attempt unauthorised access to systems or accounts; infringe the rights of others; or use automated methods in a way that imposes an unreasonable burden on the website or violates applicable law or third-party rights.
2. Product Information and Availability
We aim to describe and present our products accurately. Product photographs, colours and appearance may vary slightly because of screen settings, photography and, where relevant, the individual characteristics of handcrafted products. Such normal variations do not affect any statutory rights you may have if goods do not conform to the contract.
Product availability can change. Displaying a product on the website does not guarantee that it will remain available until your order has been accepted.
3. Orders and Contract Formation
When you place an order, you offer to purchase the products in that order at the price and on the terms shown during checkout. We will acknowledge receipt of your order electronically. A sales contract is formed when we accept your order.
Before accepting an order, we may refuse it for legitimate reasons such as lack of stock, an obvious pricing or technical error, inability to deliver to the requested address, or a reasonable fraud or security concern. If we have taken payment for an order that we do not accept, we will refund the amount paid.
If a problem arises after an order has been accepted, we will contact you and handle the matter in accordance with the contract and applicable law.
4. Prices, Taxes and Payment
The price payable for your order, together with applicable taxes, shipping charges and other charges that we collect, will be shown before you place the order. Where a charge cannot reasonably be calculated in advance, we will disclose that an additional charge may apply where required by law.
Available payment methods are those displayed during checkout. Payments may be processed by Shopify or other payment service providers. Those providers may process payment information under their own terms and privacy notices. Full payment card details are generally handled by the relevant payment provider rather than directly by us.
If we identify an obvious pricing or technical error before accepting an order, we may correct the error or decline the order and will inform you where appropriate. If an error affects an order that has already been accepted, we will contact you and resolve the matter in accordance with applicable law.
5. Shipping, Delivery and Risk
Shipping methods, estimated delivery times and other delivery information are described in our Shipping Policy and during checkout.
Where consumer law applies, we remain responsible for the goods until you, or a third party designated by you other than the carrier, take physical possession of them, except where you independently commission a carrier that was not offered by us and applicable law provides otherwise.
If delivery is delayed, you may have rights under applicable law. Nothing in these Terms removes those rights.
6. Customs, Import Duties and Other Charges
For goods dispatched from within the European Union to a delivery address within the European Union, import customs duties normally do not apply.
Orders delivered outside the European Union may be subject to customs clearance, import duties, taxes or other charges imposed by the destination country. Unless such charges are stated as included or are collected from you at checkout, they may be payable by the recipient. The amount and application of these charges are determined by the relevant authorities and are outside our control.
If a shipment cannot be delivered because required import charges are not paid or customs requirements are not completed, the shipment may be held, returned or otherwise handled by the carrier or customs authority under their procedures. We will handle any resulting order, return or refund in accordance with applicable law and may deduct or charge costs only to the extent permitted by law.
7. Withdrawal, Returns and Legal Guarantee
If you are an eligible consumer purchasing at a distance, you generally have a statutory right to withdraw from the purchase within 14 days, subject to applicable legal conditions and exceptions. Our procedures and relevant exceptions are described in our Refund Policy.
Your withdrawal rights are separate from your statutory rights when goods are faulty or do not conform to the contract. Products are covered by the legal guarantee and other mandatory remedies that apply to your purchase. Nothing in these Terms or our Refund Policy reduces those mandatory rights.
8. Customer Accounts
Customer accounts are optional where guest checkout is available. If you create or use an account, you must provide accurate information and keep your account details reasonably up to date. You are responsible for protecting your login credentials and should notify us promptly if you become aware of unauthorised access to your account.
9. Reviews and Other User Content
You retain ownership of content that you submit to us, such as reviews, ratings, photographs or comments.
When you submit content for publication, you grant Suwada1926 SRL a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, format, resize, translate and otherwise use that content to the extent reasonably necessary to publish, manage and promote the submitted content and our products or services through our own store, communications and related channels. We may permit service providers acting for us to use the content only as necessary to provide those functions.
You should submit only content that you have the right to provide and that does not unlawfully infringe another person's rights, disclose information you are not entitled to disclose, or contain unlawful material. We may moderate, refuse or remove submitted content where reasonably necessary to operate the website, enforce these Terms or comply with law.

10. Intellectual Property
The website and its content, including text, graphics, branding, photographs, designs and software, are owned by or licensed to Suwada1926 SRL or the relevant rights holder and are protected by applicable intellectual-property laws.

Except where permitted by law or by the relevant rights holder, you may not reproduce, distribute, commercially exploit or create unauthorised derivative works from protected website content. Nothing in these Terms restricts uses that applicable law expressly permits.
11. Third-Party Services and Links
Our website may use or link to services provided by third parties, including payment, delivery, review, analytics, translation and other technology providers. Third-party services may be subject to their own terms and privacy notices.
We are not responsible for third-party websites or services that we do not control, except to the extent responsibility cannot lawfully be excluded. A link to a third-party website does not by itself mean that we endorse all content or services available there.
12. Website Availability and Security
We may maintain, update or temporarily suspend parts of the website where reasonably necessary for security, maintenance, technical or operational reasons. We do not guarantee that the website will always be available without interruption, but this does not affect obligations that we have already accepted in relation to your orders or any mandatory legal rights.
13. Errors and Corrections
Despite reasonable care, the website may occasionally contain typographical, technical or other errors. We may correct website information when necessary. If a correction materially affects an order you have already placed, we will deal with the order in accordance with applicable law and will not use this clause to remove statutory consumer rights.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including mandatory liability relating to consumer rights, fraud or fraudulent misrepresentation, or death or personal injury where applicable law prohibits such an exclusion.
Subject to mandatory law, we are not responsible for losses that are not a reasonably foreseeable result of our breach or failure to exercise legally required care, or for loss caused by your misuse of the website or products contrary to provided instructions.
If you are purchasing as a consumer, limitations in these Terms apply only to the extent permitted by the consumer-protection law applicable to you. If you purchase products wholly or mainly for business purposes, different or additional legal rules may apply.
15. Suspension or Termination of Website Access
We may restrict or suspend access to the website where reasonably necessary in response to misuse, security threats, unlawful activity or a material breach of these Terms. Any such action does not remove rights or obligations arising from a sales contract already formed, except where applicable law permits otherwise.

The version published when a sales contract is formed will generally govern that contract unless applicable law requires otherwise or you validly agree to a later change.
Changes to these Terms apply prospectively from the date stated at the top of the updated version. We will provide additional notice where required by law.
17. Severability and Waiver
If any provision of these Terms is found to be unlawful, invalid or unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue to apply where legally possible.
If we do not enforce a provision immediately, that does not by itself mean that we waive the right to enforce it later.
18. Governing Law and Jurisdiction
These Terms and contracts for purchases from us are governed by Belgian law.
If you are a consumer, this choice of law does not deprive you of mandatory protections granted by the law of the country in which you habitually reside where those protections apply under applicable conflict-of-law rules.
Any dispute may be brought before a court having jurisdiction under applicable law. Nothing in these Terms requires a consumer to bring proceedings exclusively in Belgium where applicable law gives the consumer the right to bring proceedings elsewhere.
